Subject only to the police power, the right of the individual citizen to keep and bear arms shall not be infringed
it replaces the words “the people” with “the individual citizen.” to
expand the right to bear arms beyond a vauge collective militia
but why assert any individual right that is completely subordinate to state police power ,
in 1970 it was "Subject only to the police power" until the 2008 US Supreme Court affirmed
the Second Amendment to the US Constitution guarantees individual right to keep and bear arms
aside from the militia in in Dist. of Columbia v. Heller , 554 U.S. 570, 595 (2008); )
& in 2010 the Second Amendment right to keep and bear arms fully applied
to all the States in McDonald v. City of Chicago , 561 U.S. 742, 766 - 78
Section 22 legally provides less protection than the Second Amendment,
Record of Proceedings, Sixth Illinois Constitutional Convention, Vol. VI, p. 88.
The Bill of Rights Committee opinion = “[because arms pose an extraordinary
threat to the safety and good order of society, the possession and use of arms
is subject to an extraordinary degree of control under the police power.”
ergo 22 is short of an absolute and complete ban on the possession of all fire
arms a limitation of the right provided, not the State’s power to regulate that right.
